Yes, and it happens at the closing table

When an inherited house sells, the closing attorney does not hand one check to one person and leave the family to sort it out. The attorney disburses the proceeds based on who legally owns the property and in what shares, and can wire each heir directly to their own bank account.

Where the split comes from

The attorney does not decide the shares. They come from the paperwork:

  • If the house passed through probate and the estate is selling, the executor or administrator signs, the proceeds go to the estate, and the estate distributes them under the will or the intestacy rules.
  • If the house already passed to the heirs and they are on the deed, each heir signs and the attorney disburses to each of them in their deeded share.
  • If the heirs have a written agreement that changes the split, for example to reimburse one sibling who paid the taxes and insurance for two years, the attorney can follow that agreement when everyone signs it.

What the attorney needs from you

Names and contact details for every heir, the letters testamentary or letters of administration if an estate is selling, and each person's wiring instructions. The earlier the attorney has this, the smoother closing day is. Missing one heir's signature or bank details is the most common reason an estate closing slips a week.

Everyone signs. Not everyone attends
