How long does NC probate take before I can sell?

Two different clocks

The full probate process in North Carolina averages six to twelve months. Selling the house usually does not have to wait for all of it. Typically it is 90 to 180 days before a real-property sale is practical, and some sales close earlier when the executor has clear authority.

Confusing those two numbers is what keeps families sitting on an empty house for an extra half year.

What happens when

Day 1 to 30. File the will, if there is one, with the Clerk of Superior Court in the county where the deceased lived. Apply for Letters Testamentary if a will names an executor, or Letters of Administration if there is no will and the court appoints an administrator.

Day 30 to 90. Inventory the assets. Notify creditors, which includes a notice running in a local newspaper for four weeks. Begin paying valid debts and taxes.

Day 90 to 180. The 90-day creditor claim window closes. Most uncomplicated estates can begin distributing assets at this point, including selling real property.

Day 180 to 365. File the final accounting with the court, receive the final discharge, and distribute what remains to the heirs.

Why not just wait

Because the house is costing the estate money every month it sits. Property tax, insurance, utilities and lawn care for a typical North Carolina home run 800 to 1,800 dollars a month, and vacant-home insurance costs two to three times a standard policy. Six months of probate plus four months of listing plus closing can eat 10,000 to 30,000 dollars of what the heirs would have received.

Vacant homes also attract problems: mail piling up, an overgrown lawn, freeze damage in winter, squatters.
