Can I sell a rental property with tenants living in it in North Carolina?

The sale does not end the lease
In North Carolina you can sell a rental property with tenants in place. The sale does not terminate existing leases. The new owner steps into the shoes of the landlord and inherits the lease, so a tenant with eight months left on a fixed term has the right to stay those eight months regardless of the sale.
North Carolina does not require you to give tenants notice of a sale, though most experienced landlords do. Practically, telling them in advance keeps relations civil, and a courtesy note 30 to 60 days before listing is standard.
If you want to end a tenancy instead
Under N.C.G.S. § 42-14 the notice requirements are: year-to-year tenancy, written notice one month or more before the end of the current year of the tenancy; month-to-month, 7 days written notice before the end of the month; week-to-week, 2 days.
You can terminate a month-to-month tenancy with proper notice, but you cannot break a fixed-term lease just to sell. You can pay a tenant to leave early, a cash-for-keys arrangement, and one to two months' rent usually gets most tenants to vacate voluntarily.
You also cannot evict or terminate in retaliation for a tenant exercising legal rights, such as requesting repairs or complaining to code enforcement. That holds even when you are trying to sell.
Tenanted versus vacant
Selling with tenants keeps the rent coming and appeals to investor buyers, but it narrows the buyer pool, since owner-occupants cannot move in until the lease ends, and showings need tenant cooperation.
Selling vacant widens the pool and often gets a higher price, but costs you two to four months of mortgage payments without income, plus a longer timeline and the stress of getting the unit back.
