Selling an Empty or Aging South Bend House As-Is
In February 2013, South Bend set out to deal with 1,000 abandoned houses in 1,000 days. By day 1,000 the City had acted on 1,122 properties, and nearly 40% of them were repaired rather than torn down 4. The rules from that time still matter to owners. A house that has stood empty for 90 days or more and also has an unresolved repair or demolition order must be registered with the City every year 5. For a house with one to three units, that costs $300 a year 4. The owner also needs a property manager living within 50 miles, weekly checks that the house is locked, clean and mowed, and sidewalks cleared of snow within 24 hours 5. If a demolition order is affirmed and the owner doesn't act, the City can hire the demolition and bill the owner, plus administrative fees 4.
We buy houses in South Bend in whatever shape they are in, lived in or empty, dated or worn. On the call, tell us how long the house has been empty, whether any letter or order from the City is open, whether windows are boarded, and whether the water and power are on. Mention a well or a septic tank too, since the county has its own paperwork for those at closing. It all goes into the written offer, and nothing has to be fixed first.

St. Joseph County's Water and Septic Paperwork When You Sell
St. Joseph County has its own rule for every house that changes hands. Before closing, the water must be tested for total coliform bacteria, E. coli, nitrates and arsenic 1. A house on City water skips the test; a copy of the water bill goes in instead 1. The test results, or the proof of City utilities, go to the County Department of Health with a property transfer application within five days of closing 1. The buyer must have the results at least three days before closing 1.
A septic inspection is a narrower matter. Since July 1, 2024, the county asks for one only when the house sits over the St. Joseph Aquifer System, Indiana's only sole-source aquifer, and it hasn't sold or had a new septic system put in during the last 15 years 1. The application form points to an EPA map to check whether an address is over the aquifer 2. A house on City sewer needs no inspection, but if it hasn't changed hands in 15 years, a copy of the sewer bill is sent in 1. When an inspection is needed, an inspector registered with the Department opens the tank, runs at least 35 gallons of water through the system and sketches where it sits 3.
The county treats this as the seller's job, though the contract decides who orders and pays for the tests, and the Department also holds the seller's agent and the title company responsible 1. Its property transfer page says there is no fee, and test results stay good for six months if a sale falls through 1. A house that will be torn down within six months, with no one living in it after the sale, is exempt 1. Questions go to envirohd@sjcindiana.gov or 574-235-9750 1. This is general information, not legal advice.
When a South Bend House Has Become a Burden
In South Bend, a hard spot often comes with a second clock: an empty house, a City order, or the county's water-test paperwork before closing. Each note below gives the St. Joseph County side; the statewide rules are on our Indiana page. None of it is legal advice; an Indiana attorney can speak to your own situation.
Foreclosure: Indiana's court timelineThrough the courts, with a notice and a settlement conference first: generally about seven months or more from a missed payment to a sale.
A foreclosure on a South Bend house is a court case, and the St. Joseph County Clerk's office is at 101 South Main Street, 574-235-9635 6. On a home you live in, Indiana generally gives you 30 days after you're served to ask the court for a settlement conference with the lender 7, and up to the sale you can still redeem the house by paying the judgment, interest and costs 8. Selling before the sale date is another way out; tell us the date on any notice you've received, and talk with an Indiana attorney before you sign anything.
Inherited: no Indiana inheritance taxHow an Indiana house passes to the family, and who can sign to sell it.
An estate for a South Bend house goes to the St. Joseph Probate Court, 1000 South Michigan Street, 574-235-5378 6. Under the county's local rules, a deed signed for an estate doesn't need a judge's signature, and in an unsupervised estate the court won't approve a personal representative's deed at all 9. The county's water-test paperwork still applies when an estate sells 1. Tell us who has been appointed for the estate, and an Indiana probate attorney can tell you who signs.
Behind on mortgage paymentsFree Indiana housing counselors, and about four months before a servicer can file.
If the payments on a South Bend house have slipped, there is some time: a servicer generally can't make the first foreclosure filing until you're more than 120 days behind 10. Indiana's housing counseling agencies, reached through 877gethope.org, cost nothing 11. Selling is another path, and if the house has a well or a septic tank, the county's testing adds a step before closing. Call early and tell us how far behind you are.
Divorce: Indiana starts from an equal splitEverything either spouse owns goes into the division, and the court can order the house sold.
Dividing a South Bend house in a divorce starts from Indiana's presumption that splitting marital property equally is just and reasonable 12, and the court can order the house sold 13. A home a married couple bought together is usually held by the entirety, which means it takes both of you to sell it 14. Whoever handles the sale, the water test or proof of City water still has to reach the buyer at least three days before closing. Ask your attorneys what the decree allows before you agree to a price.
Selling a rental: tenants and depositsTenants can stay in place. Bring the leases and the deposit records to the call.
South Bend tenants can stay in the house while we make an offer; bring the leases, the rent amounts and the deposit records to the call. A selling landlord in Indiana stays responsible for the tenants' security deposits for one year after written notice of the sale, unless the deposits move to the buyer and the buyer notifies the tenants 15. However the deposits are handled, each one goes back, less itemized deductions, within 45 days after that tenant moves out 16.
Moving: your homestead deductionTime the sale to your move, and apply for the homestead deduction on your next Indiana home.
If you've moved away and the South Bend house now sits empty, the City's rules may reach you. Once it has been empty 90 days and has an open repair or demolition order, it must be registered, with a property manager living within 50 miles and weekly checks on locks, trash and grass 5. Tell us when you left and whether any City notice has come, and we'll make our written offer on the house as it stands.

South Bend: A Listing Next to a Cash Sale
A South Bend house that's in good repair and listed with an agent can bring more than a cash offer, if you have the months to wait. A house that has sat empty is a different sum: commission, repairs a buyer's inspector asks for, and the bills and upkeep you carry until closing all come out of the price. The St. Joseph County figures show how long homes have been taking to sell.
Work out what a listing would leave in your pocket from the South Bend cost example, then hold it up against our written offer. If listing comes out ahead and the wait suits you, list the house.

What South Bend Sellers Ask Us
Prefer to talk it through?
Call (984) 489-8269Do I have to register my empty South Bend house with the City?
The City has a demolition order on my South Bend house. What does that mean for me?
An affirmed order means the City has found the house unsafe under Indiana's Unsafe Building Law. If the owner doesn't take it down, the City can hire a contractor and charge the cost to the owner, plus administrative fees, and the process can take over 200 days 4. Tell us the order's status on the call; an Indiana real estate attorney can advise you on the order itself.
Will St. Joseph County make me get a septic inspection to sell my South Bend house?
Only if the house is over the St. Joseph Aquifer System and hasn't sold or had a new system put in for 15 years 1. If it is on City sewer, no inspection is needed, though a copy of the sewer bill goes to the Health Department when that 15-year test is met 1. This is general information, not legal advice.
My South Bend house has a well. What water test does the county want?
Every sale in St. Joseph County needs a water test for total coliform bacteria, E. coli, nitrates and arsenic before closing, unless the house is on City water 1. If well water fails federal drinking water standards, a treatment device has to go on the kitchen faucet 1. The test must be done by a laboratory registered with the Department of Health 3.
Can the buyer put off St. Joseph County's inspection and water test until after closing?
How quickly could you close on my South Bend house?
In as little as 14 days after you accept our written offer, if the title is clear. The county wants any water test or septic results in the buyer's hands three days before closing, and those results stay good for six months 1. So if your house has a well or septic, getting the test done early keeps your chosen date on track.

Yes. We also buy houses in Roseland, Indian Village, Notre Dame, Mishawaka, Granger, Osceola, Lakeville, New Carlisle, North Liberty and Walkerton 19. If you're not sure, call us.
