The 120-day floor

Under 12 CFR § 1024.41(f)(1), a mortgage servicer may not make the first notice or filing required for a foreclosure process unless the borrower's loan obligation is more than 120 days delinquent. There are narrow exceptions, but for an ordinary North Carolina home loan that rule gives you roughly four months of protected time from the first missed payment.

That is the floor, not a schedule. Many servicers take longer, and the letters that arrive well before day 120 are collection letters, not foreclosure.

What happens after the filing

North Carolina uses a non-judicial power-of-sale process that runs through the Clerk of Superior Court in the county where the property sits. N.C.G.S. § 45-21.16(a) requires the notice of hearing to be served not less than 10 days before the hearing, with posting on the property at least 20 days before it. At the hearing the clerk must find six things before authorising a sale, including a valid debt, a default, a right to foreclose, proper notice, compliance with the home-loan pre-foreclosure requirements and no servicemember bar.

From first missed payment to sale, the whole thing typically runs six to nine months.

Where you are on the ladder changes your options

Three to five months: forbearance or a loan modification. Five or more months, or after a foreclosure filing, the options narrow to a short sale, a deed in lieu, or a cash sale.

CFPB rules also require your servicer to send loss mitigation information by day 45 of default. A great many homeowners throw that letter away as junk mail.

Do not wait for certainty

The earliest opportunities are the best ones, and almost nobody regrets calling too early. If you have equity and some time before a sale date, selling is usually the option that keeps the most of it.
