Can I sell my house before the divorce is final in NC?

Yes, with both signatures

You can sell before the divorce is final if both spouses agree and both signatures are on the deed. Many North Carolina couples sell during the one-year separation period, since you must be legally separated for at least a year before filing for absolute divorce here.

If only one name is on the deed, that spouse can technically sell alone. But if it is marital property, the proceeds are still subject to equitable distribution, and selling without consulting your spouse during a divorce can create legal liability. Do not do it without your attorney's blessing.

The timing question that costs real money

Under federal tax law, married couples filing jointly can exclude up to 500,000 dollars of capital gains on the sale of a primary residence, under IRC § 121. Single filers can exclude 250,000 dollars.

So if you sell while still legally married and filing jointly, the 500,000 dollar exclusion is available. Sell after the divorce is final and each spouse can exclude only 250,000 dollars on their share. On a home with significant appreciation, that timing difference is worth a great deal.

One deadline you cannot miss

Under N.C.G.S. § 50-11, any equitable distribution claim not filed before the divorce judgment is waived forever. If your attorney has not filed an ED claim and the divorce is moving forward, call them today.
